    CORPORATE CRIMINAL RESPONSIBILITY

    Recent reforms of Spain’s Penal Code have brought about significant changes to the criminal indictment criteria with respect to companies (article 31 bis), making company directors responsible for any crimes carried out within a company, whether by one of its legal representatives or by an employee. The reforms also establish the possibility of waiving or mitigating this responsibility where a company has a monitoring and control system in place to prevent crimes. Both company directors and those professionals charged with managing a company’s legal compliance (compliance officers) have a duty to understand their responsibilities, the procedures for implementing a compliance management system and the possibilities for auditing and certifying such a system.
     

    WORKSHOP: COMPLIANCE MANAGEMENT SYSTEMS

    At this workshop, we will look at a company’s responsibilities, the role of “compliance officers” and, in particular, the ISO 19600 standard on compliance management systems: how to implement them within organisations and how to certify them. And all of this from an eminently practical standpoint.
